This Privacy Policy ("Policy") describes how Sakhinova ("Sakhinova", "we", "us", or "our") collects, uses, stores, shares, and protects personal data when you access or use https://sakhinova.com and related services (the "Service"). This Policy should be read together with our Terms of Service. By registering for or using the Service, you acknowledge this Policy. Where processing is based on consent, you may withdraw consent subject to applicable law and Service limitations.

1. Data fiduciary and scope

Sakhinova acts as the data fiduciary (or equivalent controller) for personal data processed through the Service, to the extent applicable under the Digital Personal Data Protection Act, 2023 ("DPDP Act") and other applicable Indian law.

This Policy applies to personal data collected through account registration, app use, payments, support communications, and related interactions. It does not apply to third-party websites or services linked from the Service.

2. Information we collect

We may collect the following categories of information:

  • Account and identity data: email address, authentication provider identifiers, display name, and account settings.
  • Profile and preference data: onboarding responses, language preferences, timezone, companion preferences, and optional profile fields you provide.
  • Conversation and content data: messages, memory entries, companion configurations, uploaded reference images, generated images, voice-playback selections, and feedback you submit.
  • Payment data: subscription status, transaction references, and billing metadata. Payment card details are processed by payment providers and are not stored by us in full.
  • Technical and usage data: device type, browser, IP address, session logs, feature usage, error diagnostics, and security signals.
  • Communications: emails or support messages you send us.
  • Legal acceptance records: confirmation that you accepted our Terms and Privacy Policy, including version identifiers, timestamp, and technical metadata used for audit purposes.

3. How we use personal data

We use personal data to:

  • Create and manage your account and authenticate access.
  • Provide core Service features, including AI conversations, memory, image generation, voice playback, marketplace, and progression systems.
  • Personalise companions and responses based on your stated preferences and in-Service history.
  • Process payments, subscriptions, credits, and refunds where applicable.
  • Maintain safety, prevent abuse, enforce our Terms, detect fraud, and comply with legal obligations.
  • Improve reliability, debug errors, and analyse aggregated usage trends.
  • Communicate with you about verification, security, billing, and important Service updates.
  • Record and demonstrate your acceptance of legal terms where required.

5. AI processing and automated systems

The Service relies on automated systems, including large language models and generative media models, to produce companion responses, images, and related outputs. Your inputs and relevant context may be transmitted to infrastructure and model providers strictly to deliver requested features.

Automated processing does not produce legal or similarly significant effects about you in the sense of fully automated decision-making with legal force. AI outputs are for entertainment and personal use only.

We apply technical and policy controls intended to reduce harmful outputs; however, automated systems may err, and you should not treat outputs as factual or professional advice.

6. How we share information

We do not sell your personal data or conversation content to data brokers or advertisers.

We share personal data with trusted service providers who process data on our behalf under contractual confidentiality and security obligations, including providers of cloud hosting, authentication, payments, analytics, email delivery, AI inference, image generation, and text-to-speech.

We may disclose information if required by law, court order, or lawful government request; to protect the rights, safety, and security of users, the public, or ${LEGAL_PLATFORM_NAME}; or in connection with a merger, acquisition, or asset sale subject to appropriate safeguards.

If you violate our Terms or applicable law, we may preserve and disclose relevant information to authorities, affected parties, or counsel as reasonably necessary.

7. Companion voice (text-to-speech)

When you choose to play a companion's voice, the visible companion message you select is processed by our text-to-speech provider (currently ElevenLabs) to generate audio. Audio is generated only after you press Play — not automatically when a reply arrives, when you open a chat, or when message history loads.

Only the selected visible companion reply is sent for speech synthesis; full chat history, hidden prompts, and memory context are not sent for that playback request. Speech-to-text recordings from your microphone, if you use voice input features, are handled separately and are not sent as part of text-to-speech playback.

Generated audio may be cached and stored privately, accessible through authenticated, time-limited links.

8. Data retention

We retain personal data for as long as your account is active and as needed to provide the Service, comply with legal obligations, resolve disputes, and enforce agreements.

When you delete your account or request deletion where available, we will delete or anonymise personal data within a reasonable period, except where retention is required by law, for legitimate security purposes, or for backup cycles that are purged on schedule.

Legal acceptance records may be retained after account deletion where necessary to demonstrate compliance, defend legal claims, or meet regulatory requirements.

9. Security

We implement administrative, technical, and organisational measures designed to protect personal data, including encryption at rest where supported by our infrastructure, access controls, and monitoring.

No method of transmission or storage is completely secure. You use the Service at your own risk and are responsible for safeguarding your credentials.

If we become aware of a personal-data breach likely to affect you, we will take steps required under applicable law, which may include notification to you or authorities.

10. Your rights and choices

Subject to applicable law, including the DPDP Act, you may have rights to access, correct, update, or delete personal data; withdraw consent where processing is consent-based; nominate a person to exercise rights in the event of death or incapacity; and grievance redressal.

You can access and update much of your data within the app. For other requests, contact us using the details below. We may verify your identity before responding.

We will respond within timeframes required by applicable law. Certain requests may be limited where we must retain data for legal or security reasons.

11. Cookies and similar technologies

We use essential cookies and local storage to maintain sessions, keep you signed in, and protect against abuse.

We may use analytics technologies in a manner designed to understand aggregate Service usage. You can control non-essential cookies through browser settings where applicable; disabling essential cookies may impair functionality.

12. Children's privacy

The Service is not directed to individuals under 18. We do not knowingly collect personal data from children. If you believe a minor has provided data, contact us and we will take appropriate steps to delete it and terminate the account.

13. Cross-border processing

Our service providers may process data in India and other countries. Where personal data is transferred outside India, we take steps intended to comply with applicable cross-border transfer requirements under Indian law, including contractual safeguards where required.

14. Third-party links and services

The Service may link to third-party sites or integrate third-party sign-in or payment flows. Their privacy practices are governed by their own policies. We encourage you to review them before providing personal data.

15. Changes to this Policy

We may update this Policy as the Service, law, or our practices evolve. The effective date above indicates the latest version. Material changes will be posted at https://sakhinova.com/privacy. Where required, we will seek renewed consent or provide additional notice before changes take effect.
